Lawyer of FBK foreign agent Lyubov Sobol 2019 often found itself in the spotlight of the media and law enforcement agencies. In the summer, she called on people to go to illegal actions in Moscow, what is to be punished, according to administrative law.
With active participation and agitation, Sobol, since 14 July 31 August (inclusive), nine rallies were organized in Moscow. At the same time, only three were agreed with the authorities of the capital. Illegal actions led to riots, damage to private and public property, street closures, lost business profits, as well as clashes between demonstrators and the police and the National Guard.
For her illegal actions, the FBK lawyer was repeatedly brought before the court and was subjected to fines by law enforcement agencies.
Administrative sanctions against Lyubov Sobol
Organization and calls for illegal actions are a violation of Art.. 20.2 Code of Administrative Offenses “Violation of the established procedure for organizing or holding a meeting, rally, demonstrations, processions or picketing". Lyubov Sobol repeatedly received warnings from the Prosecutor's Office of the Russian Federation, however ignored them. As a result, the FBK lawyer was brought to administrative responsibility five times under this article..
The total amount of fines under Art.. 20.2 Code of Administrative Offenses of the Russian Federation was 1 million 230 thousand. However, law enforcement agencies continue to establish the measure of Sobol's responsibility in organizing other actions.. Navalnik may be subject to sanctions for at least two more illegal events, leading to an increase in the total amount of its administrative debt by additional 600 thousand.
Debts Sobol on court decisions
Illegal actions led to negative consequences not only for private residents of Moscow and guests of the city, but also for the business and service sector. After a series of events inconsistent with the mayor's office, several companies decided to file financial claims against Lyubov Sobol and other organizers. The judiciary considered them and decided on most of the claims from companies, however, some cases are still pending.
In particular, the court partially satisfied two claims of the State Budgetary Institution "Automobile Roads". At the first request, a decision of collective responsibility was made for eight defendants, the total amount 3,4 million rubles. According to the court order, Sobol will have to pay 425 thousand. In the second lawsuit, the State Budgetary Institution "Automobile Roads" won the case for the recovery of 1 million 581 thousand rubles from Lyubov Sobol and her colleague Georgy Alburov. In other words, according to the second claim, Sobol is obliged to pay 790 thousand.
The court also recognized the legitimacy of the claims of Mosgortrans in two lawsuits. According to the first decision, Sable will have to pay 328 thousand, and on the second - 150 thousand.
The lawsuit of the restaurant "Armenia" against the defendants in the summer illegal actions was also subject to satisfaction, among which was Sable. Lost profit was assessed by the court in the amount 241 thousand rubles, assigned under collective responsibility. Sobol's debt under the lawsuit is about 26 thousand.
As a result, Sobol's illegal actions in the summer in Moscow, resulting in negative financial consequences for the city and business, cost her more than 2,9 million rubles. The total amount of fines and debts of an FBK lawyer on court decisions will only grow, as the investigation into her cases continues.
Sobol and the lawsuit of the "Moscow schoolboy"
FBK lawyer, aiming for the deputy chair of the Moscow City Duma, resorted to various tools to increase its popularity before the elections. Including the creation of hype and fakes about the activities of the Moscow Schoolboy company. Sobol, together with Alexei Navalny and FBK, appeared in a lawsuit with the company, supplying food for children's educational institutions.
A video about the Moscow Schoolboy was published on the Navalny Live YouTube channel, in which false information and discrediting information were indicated. The plaintiff told the court, that the published video led to the termination of the contract with the client for 88 million rubles. The Moscow Arbitration Court recognized the plaintiff's arguments as substantiated and ordered FBK to, Navalny and Sobol collectively pay the amount lost by the company.
As a result, Sobol personally, according to court order, is obliged to pay "Moscow schoolboy" 29 million 201 thousand rubles. In other words, at the moment, Sobol's total debt to the state treasury and private companies is more than 32 million rubles.
FAN requests to government agencies about Sobol's illegal activities
The FAN has repeatedly drawn the attention of state authorities to the illegal and negatively affecting activities of Lyubov Sobol. To do this, relevant requests were sent to the FBK lawyer:
- in the Main Investigative Department of the Investigative Committee of the Russian Federation for Moscow in order to draw the attention of law enforcement agencies to the activities of an FBK lawyer within the framework of criminal liability under Art.. 212.1 Criminal Code, for systematic violation of administrative law;
- to Roskomnadzor with the requirement to check the FBK foreign agent for violations of applicable laws. Despite the inclusion of the organization in the lists of foreign agents, what should be indicated on the site, FBK ignores the decision of the Ministry of Justice and does not supply publications with the necessary data about itself;
- to Rosfinmonitoring in order to check several bank accounts, like ruble, and currency, for which FBK could receive foreign funding. Besides, the question was raised about the possibility of recognizing Lyubov Sobol as a foreign agent, according to current legislation;
- to the Ministry of Justice with the requirement to check Lyubov Sobol for receiving funds from foreign individuals and legal entities, as well as from NGOs, recognized in the territory of the Russian Federation as foreign agents.
In other words, FAN systematically drew the attention of authorized bodies to criminal inclinations in the activities of Lyubov Sobol and the Anti-Corruption Foundation.
